Terms of service
1) Introduction
These general terms and conditions of sale (hereinafter, "General Conditions") govern the purchase of products displayed and available for purchase through the Pian della Mussa e-commerce service offered via this website (hereinafter, the "Site"), in compliance with Italian legislation under Legislative Decree 206/2005 and subsequent amendments and additions (hereinafter, the "Consumer Code"), where applicable. The products are sold by: Pian della Mussa Srl (VAT and Tax Code: 01060390018), with registered office in Balme (TO), Villaggio Albaron 1.
2) Acceptance of the General Conditions
Anyone accessing the Site to make purchases (hereinafter, the "Customer") is required, before submitting an order, to carefully read these General Conditions, which have been made available on the Site and can be consulted by the Customer at any time, including via the link contained in the confirmation email of each order, to allow for reproduction and storage. In any case, the use of the Site to make purchases implies the acceptance of the General Conditions.
3) Contractual Binding
Contracts concluded by purchasing goods through the Site are governed by these General Conditions in compliance with Italian law. Even if concluded online, all purchases made through the site are binding contracts under the Law. The language available for concluding the contract is Italian.
4) Products
The characteristics and price of each item available on the Site (hereinafter, the "Product") are listed on the page relating to each Product, which also shows its price. The image of the products, if present, is purely indicative. However, the user is required to examine all product photographs to take note of ingredients and additional information relating to that Product, where contained in the images and not in the product description itself. We constantly update the information relating to each Product: the Customer undertakes, in any case, to verify the list of ingredients and any additional information on the packaging of the product received.
5) Purchase
After adding each Product to the "cart" (using the "+", "add to cart", or similar button), the Customer may purchase it/them by consulting the cart or using the cart icon in the top right menu. To review the goods selected for purchase (adding or deleting them), it will also be possible to use the "open cart" button or similar. Shipping costs, if due, will be displayed in the cart based on the type of delivery or collection chosen by the Customer and the place of delivery. The Product or Products can then be purchased using the button provided to complete the order. The Customer will then be asked to specify their billing and delivery data and the chosen payment method.
6) Prices and Shipping Costs
Product prices include all taxes and duties and are all expressed in Euros. Upon ordering, the cost of the order will be charged to the chosen payment method. For orders under 35 euros, shipping costs 7.90 euros; for orders of 35 euros and above, shipping is free. We will endeavor to ensure that carriers always respect delivery terms: however, these are to be considered indicative. In any case, the Customer acknowledges and accepts that the timing, methods of delivery, and cost may vary depending on the delivery location.
7) Payment Methods
During the "checkout" phase, the accepted payment methods will also be indicated, with a request to specify one. The payment methods currently available are as follows:

8) Order Confirmation
Once the order has been placed, a confirmation will be generated, also showing the "order number." The order will be stored electronically in our database and will be forwarded to the email specified by you during the ordering phase, or associated with your account if you have logged in to the site.
9) Commencement of Delivery Terms in Case of Payment by Bank Transfer
Payment by bank transfer is not accepted on the Biobottega website. Contact supporto@piandellamussa.com if this is the only available payment method. In the case of payment by bank transfer, it is necessary to indicate the order number as the reason for the transfer itself. Also, in the case of payment by bank transfer, shipping is subject to the actual receipt (credit) of the full amount of the sale price.
10) Consumer Rights: Right of Withdrawal
Pursuant to articles 49 et seq. of the Consumer Code, we inform the Customer who qualifies as a Consumer (excluded in case of a request for an invoice for a company or individual enterprise) that: a) they may exercise their right to withdraw from the purchase contract for any reason, subject to the cases of exclusion indicated in letter d) below. b) the right can be exercised using the form referred to in Annex I, part B, of the Consumer Code, available at this link: https://www.agcm.it/... c) this form, or an equivalent declaration of withdrawal, must be sent at the latest within 14 days from the date of receipt of the Product or Products, or, possibly, before their receipt. The Products for which it is possible to exercise the right of withdrawal must, in any case, be returned to the selling company at the addresses indicated in the introduction. d) pursuant to the Consumer Code, this right is excluded with regard to:

Custom-made or personalized products;

Products that risk deteriorating or expiring rapidly;

Products that have been opened after delivery;

Sealed products that are not suitable for return for hygienic reasons or related to health protection.
The Customer acknowledges that, presumably and unless otherwise indicated, all food Products sold are products that "risk deteriorating or expiring rapidly." In case of doubt, you can contact the telephone numbers indicated in the Introduction for any appropriate verification.
11) Consumer Rights: EU Online Dispute Resolution Platform
Every consumer residing in the EU, Norway, Iceland, or Liechtenstein, pursuant to art. 14 of Regulation 524/2013, can use the European Union ODR platform to attempt to resolve an out-of-court dispute relating to and/or arising from online sales contracts for goods and services. 12) Modification of Conditions
We reserve the right to modify the General Conditions, as well as the information for each product, by giving notice through the publication of the new General Conditions or information on the Site. The new conditions or information will be binding from the date of publication.

If you are an individual qualifying as a European consumer, you have the right to use the online platform provided by the European Commission for dispute resolution. Every consumer residing in the EU, Norway, Iceland, or Liechtenstein can use it to attempt to resolve any dispute relating to and/or arising from online sales contracts for goods and services out of court.
